    Modification in License (Central/State) in India – Form C & Non-Form C – Overview

    FSSAI has notified all kinds of businesses to submit the details in Form B while applying for Form C or non-Form C modification. While applying for license modification (Form C), Food Business Operator (FBO) must pay a charge of INR 1000. They also need to pay the differential price which is equal to the difference in the yearly license fee in the case of an upgrade. Modifications to non-form C details, such as a change in Form IX Nominee or any accompanying documentation, are free of cost. Typically, the process is completed within 30-45 days. And, the manufacturers receive the license depending upon the accuracy of documents submitted. One might receive instant modification in case of non-high-risk-standardized food products.

    Certainly, Food Businesses have the option to keep their current License/Registration number even when altering their premise address. This can be accomplished by submitting a modification application on the FoSCoS Portal along with the relevant modification fee.

    I hold two FSSAI licenses, one State License and One Central for my food business unit. Is it correct to hold two licenses at a single premise?

    FSSAI License is purely premised based. No FBO is allowed to possess more than one license for a single premise. Additionally, if a modification in production capacity results in a shift in the license category, such as from State to Central, the FBO is required to apply for the modification of the existing State License to the Central License category. This process entails a modification fee of Rs. 1000/- along with the difference between the State License fee and the Central License fee.

    The production capacity of my manufacturing unit has increased and now, I am falling under the Central License. How can I update the production capacity?

    If the change in production capacity leads to a change in the criteria of the License i.e. from State to Central, then FBO must apply for modification of the existing State License to the Central License category with a modification fee (Rs. 1000/-) plus a differential amount between the State License fee and the Central License fee.

    I already have an FSSAI’s State license. Can I import food products on the same license?

    Food Business Operators (FBOs) must secure FSSAI's Central License under the Importer category when importing food products into India. If they possess an existing FSSAI State License, it is essential to modify it to the Central License category for the inclusion of Importer (Kind of Business) KoB. This modification incurs a fee, plus the differential amount between the State License and Central License fees.

    I have an FSSAI license/registration under ‘Supplier’ and/or ‘Marketer’ Kind of Business (KoB), but it is disabled now from the online system (FoSCoS). What action do I need to take?

    The ‘Supplier’ and/or ’Marketer’ category has been disabled w.e.f. 16th September 2021 due to the overlapping nature of the activity. Existing FSSAI licensee under ‘Supplier’ and/or KoB license may still renew their license under the same KoB but are required to modify the license/registration & select the appropriate KoB during the subsequent modification of the license/registration.
