You can use a smartwatch to deduce temperature, blood pressure, heart rate, steps, humidity and many other such measurable factors. This has brought smart watches and their business under the observation and regulation of the Legal Metrology Act of India.
The Legal Metrology Department is responsible for ensuring that devices involved with the examination of measurements and weights must be reliable and their manufacture, sale and service must be monitored by proper protocols and authorities. This ensures uniformity among caliberable metrics and also conforms that a user can rely upon the device.
You can either be a manufacturer, dealer or a repairer of smart watches. Either one, two or all of them. In order to operate a business related to smart watches, you need to obtain a license from the Legal Metrology Department. Here we’ll talk about these different types of licenses and the procedure to obtain them.
The manufacturers of Smart watches in India need to obtain the License as Manufacturer from the respective State Legal Metrology Department in which the manufacturing premises is located.
The manufacturing of such watches may be intended for sale in India, export or any other purpose like R&D, scientific investigation or research,This license is regulated under Model of The Legal Metrology (Enforcement) Rules, 2010 and The (State) Legal Metrology (Enforcement) Rules, 2011.
The License as a Manufacturer can be obtained for minimum period of 1 year and maximum of 5 years subject to the prescribed fees to be paid and the renewal of such licenses needs to be filed 3 months prior to the date of expiry.
Dealers involved in the trading and marketing of Smart watches in India which have the capability of weighing or measuring the parameters as defined under the Legal Metrology Rules need to obtain their License as a Dealer from the State Legal Metrology Department respective to the state where their business is located and operational.
This license is regulated under Model of The Legal Metrology (Enforcement) Rules, 2010 and the (State) Legal Metrology (Enforcement) Rules, 2011.
License as Dealer can be obtained for minimum period of 1 year and maximum of 5 years subject to the prescribed fees to be paid and the renewal of the expiring licenses needs to be filed 3 months prior to the date of expiry.
For carrying out repair and service jobs of smart watches with the capability of weighing or measuring the relevant Legal Metrology parameters, the repairer needs to obtain License as a Repairer from the State Legal Metrology Department respective of the state where the business is located.
This license is also regulated under Model of The Legal Metrology (Enforcement) Rules, 2010 and The (State) Legal Metrology (Enforcement) Rules, 2011. There are several conditions that needs to be fulfilled to carry out the repair of such smart watches. One such condition is the presence of a fully functional repair workshop and basic repair equipment in the premises.
The License as Repairer can be obtained for minimum period of 1 year and maximum of 5 years subject to the prescribed fees to be paid and the renewal of the expiring license needs to be filed 3 months prior to the date of expiry.
The smart watches with weighing or measuring capabilities of the parameters listed under the Legal Metrology purview such as temperature, pressure, blood pressure, heart rate, distance measurements, etc., will need to get all their products verified and stamped from the State Legal Metrology Department after their manufacture or import in India.
The verification and stamping is regulated under Model of The Legal Metrology (Enforcement) Rules, 2010 and The (State) Legal Metrology (Enforcement) Rules, 2011.
The prescribed fees according to The (State) Legal Metrology (Enforcement) Rules, 2011 needs to be paid per product for the said purpose as verified by the Legal Metrology officer, the product is stamped and Certificate of Verification with the payment receipt is obtained with mark of the year and its quarter of verification.
The Verification certificate is valid for 12 months from the date of issue and can be renewed in the last quarter of the year without any additional fee or penalty.
The business operator can get the Verification renewed in the last quarter of the valid year in which it was verified without paying a penalty.
