As per the Legal Metrology (Packed Commodities) Rules enforced on 1st April, 2011, the compliance of the provisions of these regulations is essential by the assigned field officers. However, if the governing body (Government / NPPA / any Statutory Body) permits a revision in the price, the industries may be permitted to do so in accordance with the published notification.
The Legal Metrology (Packed Commodities) Rules, 2011 provides regulations for provisions on medical devices. In view of Rule 26 (exemption in respect to certain packages), no exemption will be applicable to medical devices declared as drugs As per Rule 6 (1)(e) of the Legal Metrology (Packed Commodities) Rules, 2011, the retail price should indicate the maximum retail price inclusive of all taxes in Indian currency. For packages containing alcoholic beverages or spiritous liquor, the state excises law and the rules imposed therein shall be applicable within the state in which it is manufactured. However, if the state does not provide for the declaration of the retail sale price, the provisions of these rules shall apply. The officers' adherence to the rules set forth in these regulations is crucial. If the governing body approves a price revision, the industries may be allowed to do so in accordance with the published notification.
